I get it. I’m not trying to disrespect your concern. At the same time, I think it’s a right-sizing. There are rapes/assaults that stem from misunderstanding, intoxication, etc. and those can be tragic for all parties involved, but the more violent rape that people think of is about power. In cases where that’s the potentially the dynamic, I think the playing field is skewed from the start and these changes can help level it.

As far as I know the rule applies to in-school mediation not legal proceedings. Schools deal with policy issues all the time in a different manner than they would be handled in court. Do people get criminal prosecutions for cheating on a test?

Well this went off the rails.....

I occasionally have to do rape exams at work and have seen some horrific shit, and sometimes that horrific shit is coming from the detective who makes it clear they don't want the just devastated person to make them do paperwork. It's infuriating. 

I too was once a college aged male and wanted to believe the myth that there's some false equivalency on this and that innocent guys are having their life ruined by false accusations at anything near the rate of women getting raped, then I read a book or two and looked at data and generally pulled my head out of my ass.... it's just not reality. 

The specifics of the process are irrelevant. The fact that colleges are tasked with any of this is insane. Just insane. And the only reason they want to do this is to keep crime stats down. That's it. The more crime you punish or sweep under the rug in house, the better actual crime statistics look. When your goal is to make your campus look safe, of course you're going to lean towards rules that let you punish anyone and everyone accused but in an off the books manner. They have zero incentive to err on the side of the accused and they're not going to. This is clearly in contrast to some basic principles of our criminal justice system.

That being said, most of these cases exist in the grey area and that's why they're so hard to prosecute, but it is not difficult for a guy to keep himself out of the grey area if you have an ounce of self control and keep it black and white. Basically don't get drunk and try to hook up. I know that's asking a lot.........

For anyone interested, this book was a great read and changed the way I approach rape victims in the ER.

My recollection is that alcohol is a significant contributing factor in a majority of cases, but alcohol is also promoted as a part of the college lifestyle for the most part. 

You also brought up a good point that, by handling things internally rather than turning them over to the proper authorities, they keep their crime statistics down, especially violent crime. A disgusting practice in my opinion.

It seems like a huge, important aspect of the accused to defend himself has been removed. I am speaking about the right to face one's accuser. I don't care so much about the "trauma" to the accuser if the accused gets railroaded for a crime he did not commit.

In (most) cases wherein the crime actually happened, I feel sorry for the victim if he or she is traumatized for having to stand up to the perpetrator. However, that is part of being brave and doing what is right.

In a wider scope, I am very much worried for the future of this country as our basic rights are getting eroded, piece by piece. Soon it may be illegal to defend one's self at all, and an accusation will be tantamount to a conviction.

If a person doesn’t have the strength to stand before the one they are accusing and denounce them, then they probably don’t have strength in their conviction that whatever it is they are accusing the other of is the whole truth.

If a person doesn’t have the strength to stand before the one they are accusing and denounce them, then they probably don’t have strength in their conviction that whatever it is they are accusing the other of is the whole truth. 

That’s the original premise of my thoughts on the discussion we were having. Combined with the simple fact that they’ve dragged the whole gender identity/pronouns argument into the arena of Title IX…

The idea that something that started out as an instrument to empower women’s sport…has evolved into this POS…?

That’s where I’m at.

Now that college kids are getting thrown out of school for protesting the war in Gaza do you guys understand how students don't have the same rights when it comes to school policy vs criminal prosecution.
